Menu append creates invalid HTML when appending to an empty referenceItem

Reproduction of the problem

1. Open the Dojo - https://dojo.telerik.com/@sspasova/IPOVovUF
2. Click on the append button and inspect the element

Current behavior

The li element is created but it is outside the targeted ul element, thus, the style for changing its color is not applied.

Expected behavior

The newly created 'li element should be inside the ul element

The issue is a regression starting with the 2023 R2 (2023.2.606) version
